Our recommendation to each and every
client is that they put in place a Will. Effective estate planning
can assist and minimise tax payable on their estate.
Not having a valid Will in place can result in disharmony between
family and friends which may result in costly litigation.
Probate is the area of law which deals with the Administration
of Estates. In this regard we act for and advise executors and administrators
of estates. It is the executors responsibility to see that
the provisions of a Will are carried out in full. Each Will appoints
at least one Executor to deal with the administration of an estate.
Where no Will has been prepared an administrator may be appointed
to implement the provisions of the Will.
Beneficiaries are notified of any bequest made to them. Taxation
of this bequest is also dealt with by us on the basis of the information
provided by the beneficiaries.
Capital Acquisition Taxation is the area of the tax most likely
to effect probate matters.
Administration of the estate remains the executors or administrators
responsibility until the last of the deceaseds assets, liabilities,
holdings, share holdings have all been dealt with an accordance
with the terms of either The Succession Act 1965 or the terms of
the Will.
